Ox2 Net  – Hosting Agreement

  1. Overview

The Universal Terms of Service Agreement sets forth the general terms and conditions of your use of the Site and the Services. This Hosting Service Agreement this (“Service Agreement”) governs your use of Ox2 Net ’s Hosting services “Hosting Services”). Capitalized terms used in this Service Agreement, but not defined are defined in the Agreement.

  1. DESCRIPTION OF SERVICES
  2. ACCOUNT TERMINATION; LIMITATIONS

If you purchased Managed SSL and are using an SSL certificate on a website hosted by us, we will generate and securely store a corresponding private key. For security reasons, at no time will we release your private key, even per your request. If you wish to export your SSL certificate for use on a non-Ox2 Net  server, request a re-key of the SSL certificate – your current SSL certificate will become invalid and we will issue a new certificate for use on your non-Ox2 Net  server.

We will automatically validate, issue and install the new certificate every two years for subscribing customers using our hosting products. Customers using 3rd party hosting products will be required to reinstall the new certificate after we automatically validate and issues a new certificate. We will alert customers when to take action via the product dashboard and email.

You are permitted to assign a representative the authority to (1) sign and submit, or approve a certificate request on your behalf, (2) sign and submit a Subscriber Agreement on your behalf and/or (iii) to acknowledge the Terms of Use on your behalf, provided you acknowledge and agree that you are and will remain subject to and bound by all terms and conditions of this Agreement.

  1. PROVISIONS SPECIFIC TO SUPPORT PLANS

Further, you are responsible for ensuring that any product posted for sale on your website is in compliance with all applicable laws and regulations where your items can be purchased. We reserve the right and sole discretion to determine whether the sale of any particular item is illegal or otherwise prohibited and cancel your Services.

We offer a Service uptime guarantee of 99.9% (“Service Uptime Guarantee”) of available time per month. If we fail to maintain this Service Uptime Guarantee in a particular month (as solely determined by us), you may contact us and request a credit of 5% of your monthly hosting fee for that month. The credit may be used only for the purchase of further products and services from us, and is exclusive of any applicable taxes. The Service Uptime Guarantee does not apply to service interruptions caused by: (1) periodic scheduled maintenance or repairs we may undertake from time to time; (2) interruptions caused by you from custom scripting, coding or the installation of third-party applications; (3) outages that do not affect the appearance of your website but merely affect access to your website such as FTP and email; (4) causes beyond our control or that are not reasonably foreseeable; and (5) outages related to the reliability of certain programming environments.

Usage Policies

How much disk space and bandwidth will my plan include?

For plans supporting “Unmetered” disk space and/or bandwidth, we do not have defined limitations, which means you are not charged according to the amount of disk space or bandwidth you use. While these resources are not infinite, we believe our customers should have all of the resources necessary to build an online presence, and the majority of our customers will have more than enough disk space and bandwidth to meet their needs.

With that being said, all use of hosting space provided by Ox2 Net is subject to our Terms of Service and Acceptable Use Policy. Disk space and bandwidth should only be utilized in the normal operation of a personal or small business website.

For example, accounts with an excessive amount of database tables (i.e. in excess of 5,000 database tables) or an excessive database size (i.e. in excess of 10GB total database usage or 5GB database usage in a single database) would be in violation of our Terms of Service and Acceptable Use Policy. What happens if I exceed usage?

If we have concerns about your account’s bandwidth or disk space utilization, you will receive an email to your account on file asking you to reduce usage.

It is very rare for a customer who is managing a personal or small business website to exceed our usage policies, however, Ox2 Net reserves the right to terminate a Subscriber account, with or without notice, for excessive use of resources that result in degradation of service performance or the Services.

Free Domain Policy

If your hosting plan comes with a free domain through Ox2 Net and you cancel within the first year, please note there is a non-refundable domain fee based on the regular cost of the domain, which can be found in your control panel, plus any applicable fees, for the domain name. The fee not only covers our own costs, but it ensures that, even if you’re dissatisfied with your experience at Ox2 Net, you won’t lose your domain name. Upon payment of the domain fee, you’ll be free to transfer it or simply point it elsewhere. Please note, however, that newly registered domains cannot be transferred to another registrar during the first 60 days of the registration period. If you elect to renew your domain name, you will retain ownership of the domain name until the end of its registration period.
